In recent news, The University of New Mexico filed an appeal last month against the city of Albuquerque after councilors voted last fall to deny the school a wavier to sell alcohol at sporting events and in the student union. "UNM's strategy in this appeal is somewhat bizarre," City Attorney Rob Perry said.

Court documents show that UNM is arguing that the city has no jurisdiction over the university, and that only the state has the power to enforce or waive liquor licenses. Perry said the state's alcohol and gaming division actually referred UNM's request to the city. "If there is a problem it's between one state agency, the University of New Mexico, and it's between the other state agency, the state alcohol and gaming division. We just did what we were asked to do," Perry said.

Albuquerque City Council President Don Harris echoes the city's argument. "So if the state of New Mexico doesn't think we have jurisdiction, they chose a funny way of expressing that," Harris said.

Last fall, UNM applied for a waiver to sell alcohol in the suites at The Pit, University Stadium and for special events in the student union building. In November, the city council denied it. The university refused to comment on the appeal.

According to the city, the state legislature allows cities to make decisions on liquor licenses in some cases.
